I can give you tips but i can't do it. I'm not a pro. You either make it by yourself, using my tips, or go to Vodabids and get someone to do the job for you.

Mail me the aesthetic and functional details of the site you want to make. Music and pictures are ok if they are not right protected, else you might get yourself in trouble

how do i know if they are protected or not?

If you copied or stole them they are protected.

what if i got them from the internet and people can only see it or listen but they cant download it and about the website can you make like a box on top on on the left on on the right and is there a way to put a background picture so basicly that is what i want

Even if people can just listen, you have to pay for the artist's and his company's rights. Aboutthe template: I don't understand what you want, you already have a nice general layout. What exactly would you like? if you have some sample sites to show me, upload the URLs for me to see.

i would like to have a template like yours yours is really cool and what about the pictures?

and by the way what program should i use for making such cool headers you know like you put a picture and lots of different shading and stuff is is adobe or something?

Adobe Photoshop is considered the top as to image creating / editing. It allows for incredible effects. But, it is a bit difficult to learn. If you do have the time and the will to learn it, you may have great results.
I use Corel Draw, that is a 2D vector designing program, with some image editing features, enough for my case. PaintShopis another one. There many others. Make a Google search

And what will your site content be? The style of any website depends mostly on what this site is desiged to do

something like download you know so i can put like a picture and write some stuff about it under the picture like the one i showed something like that

No didn't. To be honest i didn't even know if you would come back. However, as i told you i'm not a pro, so i don't do other peoples work. i'l be glad to give you tips, but i can't work 4-5 hours just to make a template for you. Sorry

Here's a thought: why not try doing it on your own? If someone else does this stuff for you, how do you expect to ever improve your skills? Go out and get a program like Photo Shop, Paint Shop or even the free The Gimp. All are programs which will suit your needs and you'll learn a lot just by trying to build your own template. If navaldesign helps you that's great, but what are you going to do the next time if he isn't available? Think about it.
