Default Out of Business Domain Name Register

My domain name is about to expire with another company (VizaWeb) they have sent me an email but I can't do anything with it. Phone disconnected. Can't log into my cpanel, Support tickets unanswered. Link in email gets 404 error. I'm not sure if it's locked or not since I can't get to it.

Do you have any suggestions. I would like to transfer here. I'm not sure what to do. I have heard of so many scams.

I have submitted a ticket to PublicDomainRegistry support, but have not received anything back yet.

Tamara

BillyGorilly.com, right? It's hosted here, and the Domain expires Oct. 9, 2009:
Domain Name: BILLYGORILLY.COM
Registrar: DIRECTI INTERNET SOLUTIONS PVT. LTD. D/B/A PUBLICDOMAINREGISTRY.COM
Name Server: NS3.VODAHOST.COM
Name Server: NS4.VODAHOST.COM
Updated Date: 30-apr-2009
Creation Date: 09-oct-2005
Expiration Date: 09-oct-2009

Since their site is still up and seemingly functional (does the Chat ever look like it is manned?) you really have only 2 choices if they are not responding to any Support Emails you have sent:

1) The easiest is to let the Domain expire entirely and attempt to pick it up via Backorder with a reputable Registrar such as Go D a d d y. This will mean that there could possibly be a period when your site is down while the domain is being processed as a Backorder until it is released to you, but it is the path of least resistance. Unless, of course, they release it to a Domain Auction or Speculator since it was "active" and had measurable traffic, a value that can be converted....then you will pretty much be forced to go thru whomever and pay more to re-register it under your name. Only then will you have access to 'authorize' transfer to your GD account, since it is all done by email to registered owner.

2) You can begin the process of Official Complaint with ICANN, the organization charged with administrating Domains and Registrations globally for the entire WWW. You will need to follow their procedures specifically to detail the exact nature of your Domain being held hostage, show proof of your "ownership" and prior use (provide genuine documentation: copies of emails, Invoices, billing records, etc.), and in no uncertain terms spell out how you seek resolution (a. demand the domain be released only to you, which will compel you to ante up with VizaWeb again, wait for the hold period to pass, and then transfer it to GD where you initiated your Backorder; b. if already released to a speculator, that the domain be held in escrow by ICANN and then cleared for transfer to GD as proven ought be, since you demonstrated proper "first use" rights that if another is allowed to use will create "infringement" to your ongoing business).

You can find the ICANN Rules and Procedures here > http://www.icann.org/en/dndr/udrp/uniform-rules.htm

* Keep in mind PrivateDomainRegistry.com is a DBA for DirectiInternetSolutions Pvt. Ltd, which is probably a reseller VizaWebs uses to fulfill doamin sales to customers, so if there is a light crew at VizaWebs, extra time will need to be allowed for Support Requests to be forwarded to the actual Reseller (who in turn must go through channels to properly satisfy a request). However, if you have not received a reply within 5 business days, then something is amiss, and I would begin offical actions.

Once the Domain is at your GD Account, you can then simply set DNS to your hosting account at VodaHost.

Vasili,
Thanks for your quick response. I took care of the easy part, removing my non-vodahost web link in sig OOPs.

The rest of the reply is making me sweat or let's say glisten. I already have a support ticket to GD but then I just finished reading not so good stuff about GD. Saying they let good site names go to auction. And then they control the auction site. Or something similar. Can't tell if it's just 1 or few customers with that complaint or many.

Having my site down for a few days is not something I or anybody wants.

I'm also not sure if it helps that Billy Gorilly is a registered trademark.

I will go to ICANN.

This is not good.

Thank you very much

Any other advice appreciated

Thumbs up Re: Out of Business Domain Name Register

GD (like every other provider) is getting stupid complaints from people too stupid to follow the process regularly, on time, or are whining that they shouldn't be held responsible for their own actions: pile it on the company!
Since the "shortage" of domain names over the last 18 months, there has been some eyebrows being raised about the myopic focus of some Registrars (like GD) to capitalize on expiring domains just to get a quick buck, but honestly? If people took care of their accounts the way they should, there would never be an opportunity for someone else to do what they legally can, now would there be?

Like I said .... you will probably need to collect every bit of documantation to overwhelm the perponderance of "just cause" in your favor to include with your petetion to ICANN. Don't freak .. take it slow, be brief but absolutely precise (stick to "bullet" format, if you know what I mean) and don't worry. Trademarks are an ace-in-the-hole as far as establishing "primary use" and "intent to perpetuate freely." By the time you're done preparing things, you will have created the confidence you seek now, and that is the confidence ICANN will admit as reason to award you with the resolution you seek (if it goes that far).

Trust me! Other than driving over to the provider's house and banging on the door, there's nothing more you can do.

GD has nothing to do with your Domain until you initiate a Backorder for it at GD if the original reseller that services VizaWeb does not respond properly!
Why in the world would you create a ticket with GD if it is not their 'property' or problem? FYI: GD has a reseller DBA also, but it is Wild West Domains ...

1) If after 5 business days you get no response from VizaWeb to your emails, then go to GD and pay to Backorder your domain in case it gets so far as to expire at VizaWeb: create a "back-up plan".
2) Once you have Backordered your domain at GD, then submit your Petition to ICANN (which you should have been compling during all the waiting).
3) Keep tabs on the status of the domain via WHOIS to see if it is being released, is pending redemption to your GD Backorder, or has been transferred to another Registrar (who may have been first in line to claim it with a backorder of their own).
4) If it has been transferred to anyone but your Backorder at GD, immediately establish an identity with the new Registrar (create an "account" to get involved with them) to be able to aquire it (via auction, a higher price, etc.). Only you can determine how much you are willing to pay out of pocket to expedite getting things back to normal.
5) Keep in mind ICANN will still be processing your claim, and if you are unsuccessful retrieving it yourself, they will be your official recourse: don't mess with them, let them do what they do all the time.

I agree with Karen ... GD has been reliable for years, and I have had no problems with any of my more than 300 domains. It is always those who mess themselves up to be the loudest complainers as they dodge accountability and embarrassment both!

VodaHost and this forum are THE BEST.

And Yes you have the correct dates and domain.

I learned about the publicDomainRegistry from a blog. Another person with the same problem. He said they unlocked his account.

The VizaWeb fourm does not ever seem to be manned.

I am going to stay positive that this will turn out well.

Again, I truly appreciate your time and input on this matter. I have been working on this for over a week trying to figure out what steps to take.

Oh I created a ticket with GD to ask how to transfer my domain to them if I can't get into my account on the other provider.
