Depends on percentage of broken links compared to all links on your site.If you have a hundred links on your site and 1 or 2 are broken its not a penalty issue, if you have 4 links on your site and 2 are broken, then thats half of all links and yes, they will look at it as a unmaintaned site and a more serious issue.
